Wednesday was my birthday, and the Supreme Court in the United Kingdom (UK) was very kind and gave me a lovely gift! They gave me hope that the UK might be returning to sanity after quite a rough patch. It’s a good thing. Western Civilization needs the UK. We all suffer when they go a little nuts.
The court ruled unanimously that “transgender women” do not fit the legal definition of “woman” in UK law. The term “woman” is reserved for those born biologically female. In addition, the word “sex” now legally refers to biological sex, not whatever nonsense is going on inside any lunatic’s head at that moment.
Seems like the sort of thing mankind has always known, but hey, sometimes societies go insane.
The underlying case arose because of a 2018 law from the Scottish Parliament stating that women must make up 50% (exactly?!?!) of the representatives on Scottish public boards. Some men on these boards who hold “Gender Recognition Certificates (GRCs)” were claiming that they qualified as “women” for the purposes of this law.
Crazy law — the quota thing. Even crazier interpretation, though, and now the UK Supreme Court has struck down that nonsense.
This ruling is much bigger than the Scottish public board thing. The ruling is defining what “woman” and “sex” mean in UK law. Now that the Supreme Court has ruled, its decision states what the law has always been, not what it should be from date of judgment onwards.
This has implications for cases already concluded, cases currently being fought, how other laws must be interpreted, who has legal access to women’s bathrooms, prisons, sports teams, etc.
In the plainest of language, the court said men are not women even if they have a piece of paper saying so. “Sex” in the Equality Act of 2010 means biological sex. A person’s whim does not change that. A GRC does not change that. Men who identify as women — however they have modified themselves — are not biological women and can therefore not enter spaces reserved for women.
As you can imagine from the GRC thing I mentioned, there have been a lot of weird trans-lunacy going on in the UK. Prior to this ruling, all that was done under color of law. No more.
The women and girls of the UK still have a problem, though. Here’s an example: An adult male who feels so entitled to play dress up and sneak into women’s bathrooms that he’s threatening to throw a 2-year-old-style temper tantrum if anyone tries to prevent him.
And he’s not alone. The type of mentally unstable male who behaves this way is capable of great violence, and they’re not subtle about it either. Keep your heads on a swivel, ladies. Never let your guard down. And if possible, keep your husbands and boyfriends and brothers and fathers near.
So, thanks for the birthday present, jurists! You preside over a country far away from me, but I still have a very warm place in my heart for the UK, and I’m glad to see that all y’all haven’t gone completely insane.
As I say a lot around here, sometimes societies go insane for a little while. That doesn’t mean we have to stay insane.
